1. Acceptance of Terms
By accessing or using FableMaker (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Account Registration
You must create an account using Google or Discord authentication to use the Service. You are responsible for maintaining the security of your account. You must be at least 13 years old to use the Service.
3. Token System & Billing
- Tokens: FableMaker uses a token-based system. Each action (story generation, illustration, etc.) costs a specific number of tokens.
- Free Tier: Free accounts receive 300 tokens per month. Unused free tokens do not roll over.
- Paid Subscriptions: Paid plans (Starter, Creator, Pro) grant monthly token allocations. Unused tokens from paid plans roll over for up to one month, capped at your plan's monthly allocation. For example, a Pro plan (8,000 tokens/month) can accumulate a maximum of 16,000 tokens.
- Token Packs: Additional tokens can be purchased as one-time packs. Purchased tokens do not expire.
- Tier Changes: When upgrading, your remaining balance (capped to the new tier's rollover limit) carries over plus the new monthly grant. When downgrading, your balance is capped to the new tier's rollover limit.
- Refunds: Subscription fees are non-refundable except as required by law. Unused tokens are not refundable.
4. Content Ownership
- Your Content: You retain ownership of the stories and books you create using FableMaker. You may use, distribute, and commercialize your generated content.
- AI-Generated Content: Illustrations are generated by AI models. While you own the specific outputs created for your books, the underlying AI models and their capabilities remain the property of their respective creators.
- Restrictions: You may not use the Service to generate content that is illegal, harmful, infringing on others' rights, or that depicts real people without their consent.
5. Acceptable Use
You agree not to:
- Generate content depicting nudity, explicit violence, or illegal activities
- Generate content that infringes on copyrights, trademarks, or other intellectual property
- Attempt to circumvent token limits or billing systems
- Use automated systems to abuse the Service
- Resell or redistribute access to the Service
- Use the Service to generate content depicting real people without consent
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features at any time. We will provide reasonable notice for material changes.
7. Limitation of Liability
The Service is provided “as is” without warranties of any kind. FableMaker shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
8. Termination
We may suspend or terminate your account for violations of these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases, though we may retain certain data as required by law.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email or in-app notification.
